INTRODUCTION
Welcome to www.shipsomnia.com. This website is owned and operated by Mad Fresh Entertainment Pte. Ltd. (“Mad Fresh Entertainment”). By visiting our website and accessing the information, resources, services, products, and tools we provide, you understand and agree to accept and adhere to the following terms and conditions as stated, along with the terms and conditions as stated in our privacy policy.

Mad Fresh Entertainment reserves the right to change these terms and conditions at any time without prior notice. In the event that any changes are made, the revised terms and conditions shall be posted on this website immediately. Please check the latest information posted herein to inform yourself of any changes.

NATURE OF SHIPSOMNIA
Shipsomnia is a music & arts festival cruise vacation organized by Mad Fresh Entertainment featuring multiple headlining DJs. The passenger (“Guest”) who is buying way aboard a cruise vacation (“Cruise”) agrees to abide by all the terms and conditions from Mad Fresh Entertainment. Headlining artists will be performing numerous shows aboard the vessel throughout the Cruise. Mad Fresh Entertainment takes every effort to ensure that there is no difference in the shows and presentations, though it cannot guarantee that the Guest will be able to attend each and every performance. Individual artists will be present at advertising and promotional shows throughout the Cruise where the Guest will have an opportunity without guarantee to meet the artists personally.

CHANGES & CANCELLATION OF SHIPSOMNIA
Mad Fresh Entertainment endeavors to ensure that Shipsomnia proceed as planned. However, Mad Fresh Entertainment reserves the right to cancel, postpone the Cruise, change part or all of the cruise program and/or itinerary wherever advisable or necessary, at the port of embarkation or at any time during or prior to the sailing date.

If such an action is taken during the Cruise, Mad Fresh Entertainment will NOT be responsible for any loss or expenses caused by reason of such changes or abandonment. NO REFUNDS will be made to Guests who elect not to complete the Cruise for any reason or cause whatsoever.

In the event that Shipsomnia is cancelled or postponed before embarkation due to any unforeseen technical issues, Mad Fresh Entertainment will provide an alternative sailing date and/or vessel within 120 days. NO REFUND will be made to Guest who elect not to attend the alternative sailing date/vessel.

In the event that Mad Fresh Entertainment is unable to provide an alternative sailing date/vessel within 120 days, all guests will receive a full refund on their purchase (minus the bank/credit/debit card fees). Mad Fresh Entertainment will not be held responsible for any cost incurred as a result of the change in sailing date (e.g. fees for changes or cancellation in flights and accommodations, etc.)

MAD FRESH ENTERTAINMENT ACCOUNT
All reservations are required to sign up for a Mad Fresh Entertainment account in our reservation system. This account is used to keep track of your reservation details and the information will never be shared with any third party organizations. Please refer to our privacy policy for full details.

PRIORITY & EARLY BIRD RESERVATION
Reservation during the Priority & Early Bird period guarantees the lowest rates for each cabin category.

Early Bird reservation will be available for 3 weeks from 12:00pm Sunday, September 4, 2016 until 11:59pm on Sunday September 18, 2016. All times are based on Barcelona Standard Time (BST). Prices will be raised by US$100 per Guest after the end of the Early Bird reservation period.

Priority bookings for returning Shipsomniacs & Friends:
SUNDAY, AUGUST 28, 12:00pm, CET (UTC+1)

Early Bird Bookings opens to public:
SUNDAY, SEPTEMBER  4, 12:00pm, CET (UTC+1)
(Waiting list access 24hrs prior on Sep. 3)

IMPORTANT: Registering does not guarantee you a reservation or a specific cabin category. Cabins are sold on a 1st come, 1st serve basis.

PRICING
Mad Fresh Entertainment reserves the right to adjust prices with immediate effect without notice. Reservations made after any price adjustment(s) will adhere to the new prices. Reservations made before any price adjustment(s) will be protected at the rate they were reserved.

All prices listed are exclusive of any applicable governmental or quasi-governmental sales, use, value-added, excise or other taxes, duties, fees or charges (whether now in existence or hereafter imposed or changed).

PAYMENT METHOD
Mad Fresh Entertainment accepts VISA, MasterCard credit/debit cards.

RESERVATION FEE
The 1st installment payment (Per Cabin) is required to confirm the reservation.
For Guest(s) who enrolled in the Roommate Partnering Program, the 1st installment payment (Per Guest) is required to confirm the reservation.

PORT FEES/TICKETING FEES/GRATUITIES
In addition to the cabin price per person, all guests are subject to an additional US$212 per Guest for port fees & ticketing fees.

Guests will also be charged US$54 Per Guest (For Standard Cabins) and US$66 Per Guest (For Suites) for ship gratuities. The ship gratuities will be billed to the Guests’ account and are collected by the cruise line at the time of check-out when the Guests settle their bill. Guests are allowed to disembark after their ship account has been settled.

FUEL SURCHARGE
In the event that the cost of fuel increases between now and the time we sail, a fuel surcharge will be imposed to each Guest for the Cruise. The fuel surcharge will be added to the Guest’s cabin costs, not to exceed US$50 per Guest and must be paid in full by June 6, 2017 in order to board Shipsomnia. All Guests will be notified in advance via email if such a fuel surcharge will be added to the cost of their cabin.

PAYMENT & PAYMENT PLANS
Guest(s) has the option of choosing full payment or installment plan payment. Payment plan selection is done at the time of confirming the reservation.

Guest(s) has the option of choosing single or split billing. For reservations where split billing is selected, all the Guests in the reservation  are required to log into their Mad Fresh Entertainment account, set up their card payment details, select their payment plan and pay their 1st/full installment.

All payments made are non-refundable.

PAYMENT PLANS
100% Payment in Full: Guest(s) have the option to pay for their cabin in full when making their reservation. Guests opting to pay in full will receive a complimentary US$100 On-Board credit per cabin to spend on board [not applicable with any other promotions, offers and/or Studio Interior cabins]. The complimentary US$100 On-Board Credit only applies if the entire cabin is paid in full and is only available on a per cabin basis. The complimentary US$100 On-Board Credit can be used for any on-board purchases.
Guests who are in the Roommate Partnering Program are not entitled to the complimentary US$100 On-Board Credit even if the 100% Full Payment Plan is selected.
New reservations made and paid in full after March 4, 2017 will not be eligible for the the complimentary US$100 On-Board Credit.

Instalment Payment Plan: Guest(s) have the option to pay in up to 6 equal installments due on every 4th of the month with the 1st instalment due at the time of making the reservation. Guest(s) are required to log into their accounts to make each instalment payment. Email reminders will be sent out a week before the instalment due date. Instalments WILL NOT BE AUTOMATICALLY DEDUCTED from Guest(s) registered card on file.
Payments not received by the due dates indicated are subject to a late fee of no less than US$50 (Per Guest) each time.
Payments not received 7 days from the due date(s) indicated will result in the cancellation of the reservation and is subjected to our CANCELLATION policy.

Any reservations made after March 4, 2017 must be paid in full at time of booking.

If any Guest(s) cancel in a cabin, the remaining Guest(s) will need to pay the share of the cabin for the cancelled Guest(s) to retain the reservation/cabin; otherwise the entire reservation will be cancelled. New Guest(s) are allowed to be added to replace the cancelled Guest(s) but will incur the Name Change admin fee.

All cabin prices listed on the website are per person and are based on a minimum of double occupancy; single occupancy cabins will be charged for a double occupancy room with a US$200 discount and only need to pay the port fees, gratuities and ticketing fees for 1 person.

For cabin booking with split billing, if the roommates of the primary Guest who confirmed the reservation (“Lead Guest”) do not pay their their 1st installment within 24 hours, the reservation will be cancelled and the Lead Guest’s 1st payment forfeited.

GUEST DETAILS AMENDMENTS, CHANGES AND ADDITIONS
The Lead Guest is the only person in the reservation that can make any changes such as adding a Guest or making a name change. Reservation amendments or changes to the name of any associated Guest in the same cabin or any other adjustments will be complimentary until March 4, 2017. Subsequently all reservation changes are subjected to a US$100 administrative fee per change. Any changes to the reservation must be made through Mad Fresh Entertainment.

There can be no name change (Amendments, Changes and Additions) after May 4, 2017.

Downgrading cabins to another one of lower value is prohibited.

ROOMMATE PARTNERING PROGRAM & SINGLE OCCUPANCY ROOMS
In the case when a Guest is not able to find a roommate, Mad Fresh Entertainment will help, to the best of our ability, to find a roommate of the same sex for the Guest. All persons wanting to stay in a single occupancy room will need to pay the standard double occupancy rate but will receive a US$200 discount. Single Occupancy cabins will only be charged for the port fees, gratuities and ticketing fees for 1 person.

CANCELLATION & REINSTATEMENT
Any reservation that has overdue payments in excess of 7 days from the payment due dates indicated will be cancelled automatically.
Guest(s) may cancel their booking at anytime. NO REFUNDS will be given.

Guest(s) may reinstate their cancelled reservation subject to availability. There will be a US$200 (Per Guest) reinstatement fee.

There can be no reinstatement after May 4, 2017.

To cancel or reinstate a reservation, please email to reservations@madfreshentertainment.com with the reservation number and name of Lead Guest.

BREACH OR CANCELLATION BY SHIPSOMNIA ARTIST
Full DJ and artist line up will be officially announced on the Shipsomnia website and in the media three months prior to sailing. Mad Fresh Entertainment will enter into an agreement with each performing artist on the Cruise to be present on board the Cruise or in Ibiza and to perform in accordance with terms specified therein. However Mad Fresh Entertainment will not be held responsible for any failure of the said artists to appear or perform on board. Further, Mad Fresh Entertainment shall not be accountable for any kind of loss made throughout the trip in the occasion that such performance is prohibited or similar loss, harm, cost, or expenditure is led by or come out directly or not directly from any particular work of God, conflict, fire, crash, instructions of underwriters, taken into custody, order or self-control by any kind of government association or official working under the law of authority, acts of violence, labor disturbances or disputes, civil disorder, weather circumstances and contemplation of the security of the vessel (for which the Ship’s Master will be the one and only to make decisions), failure of or damage to the vessel ’s hull or equipment, demand of the ship by lawmaking authority, sickness, death of a family associate or other reason or circumstance past Mad Fresh Entertainment sensible control. In the event of any failure of contracted artists to perform throughout the cruise, Mad Fresh Entertainment, in its sole discretion, may employ an alternate artist or artists, or may change, reschedule or end all or any part of the Cruise or the entertainment program or adjust the program or itinerary. In such case, Mad Fresh Entertainment will have no liability to any Guest(s) for any loss, damage or expenses by cause of similar change.

AGE RESTRICTION
All Guests MUST BE 18 years at the date of embarkation in order to board Shipsomnia. Confirmation of age will be verified at embarkation and if a Guest does not meet the age criteria, he/she will be prevented from embarking and no refunds will be made.

LIQUOR & BEVERAGE
No Guest is allowed to bring any alcoholic beverages, non-alcoholic beverages or food to Shipsomnia. Mad Fresh Entertainment reserves the right to refuse the sale of alcoholic beverages to anyone. Alcoholic beverages purchased in the ship’s gift shops or in ports of call will be retained by the cruise operator until the end of the Cruise.

SMOKING
There is a no smoking policy which applies throughout the cruise ship except in designated smoking areas on the cruise ship. Ashtrays are to be used at all times while smoking in the designated smoking areas. No smoking of any kind, shall be permitted in cabins or outside on balconies. Any guests who are found in violation of the smoking policy in their cabin will be fined per occurrence as per the cruise line policy. Charges will appear on the guests on-board account and must be paid prior to disembarkation.

ZERO TOLERANCE POLICY
There is a ZERO TOLERANCE tolerance policy concerning the use, ownership, buy or supply of illegal prohibited substances. Any violation of this policy will result in disembarkation from the vessel and the individuals involved will be handed over to the local law enforcement authorities for further legal action. In such case Mad Fresh Entertainment will not be responsible for any refund or any other kind of compensation.

SAFETY
Guests acknowledge and agree that they will not sit on any railing, enter any prohibited area, or otherwise endanger themselves by their own negligence, including but not limited to being impaired by the use of alcohol, and/or under the influence of any controlled substance. Mad Fresh Entertainment reserves the right to discontinue alcohol sales to any guest at any time. Mad Fresh Entertainment urges all guests to drink responsibly at all times and cannot be responsible for actions that result from the over-consumption of alcohol.

All guests may be required to sign a form acknowledging and agreeing to the drug zero tolerance policy, responsible consumption of alcohol policy, conduct policy and disembarkation and voyage termination policies set forth herein before being permitted to embark on the cruise ship for Shipsomnia. In the event any guest sustain an accident or injury while on board, they may be requested to submit to drug and alcohol testing. Any refusal to submit to such tests shall result in the presumption that the guests were under the influence of drugs and/or alcohol at the time of the incident, and that such refusal shall give Mad Fresh Entertainment the right to disembark the guests from the vessel at the next port of call with no refund and no return passage.

VENDING
VENDING OF ANY KIND IS PROHIBITED AT SHIPSOMNIA. No merchandise of any kind (T-shirts, hats, posters, jewelry or anything else) can be sold during the Cruise. Anyone found in violation will have their unauthorized merchandise confiscated.

MEDICAL CONDITION/PREGNANCY
Guests who have a physical or mental disability or a medical condition must notify Mad Fresh Entertainment IN WRITING AT THE TIME RESERVATION IS MADE (reservations@madfreshentertainment.com) or at the time the medical condition is discovered – whichever comes first. This information may be forwarded to to the cruise line ship’s doctor for review. Failure to provide such information prior to sailing may lead to the cancellation of the reservation, subject to our cancellation policy. If sufficient time is NOT provided to make adequate determination of medical conditions or requirements, Mad Fresh Entertainment reserves the right to revoke or refuse passage to anyone who may, in the sole judgment of  the cruise line, require treatment, care or attention beyond that which the ship’s facility can provide or whose mental or physical condition may make them incapable of a cruise voyage, subject to our cancellation policy.

Guests wishing special diets or facing physical disabilities must notify Mad Fresh Entertainment in writing (reservations@madfreshentertainment.com) of such requests at least 45 days prior to sailing. There is no guarantee that the special dietary request will be met.

Pregnant women are highly recommended to seek medical advice prior to travel at any stage of their pregnancy. Women who are up to 23 weeks pregnant at the end of the Cruise are required to produce a medical certificate of fitness to travel. The cruise line cannot for health and safety reasons allow passage for pregnant Guests of 24 weeks or more at the time of embarkation. The cruise line reserves the right to request a medical certificate at any stage of pregnancy and to refuse passage if the cruise line and/or the Ship’s Master are not satisfied that the Guest will be safe during the Cruise.

Mad Fresh Entertainment expressly reserves the right to refuse boarding rights to any Passenger who appears to be in any advanced state of pregnancy and shall have no liability in respect of such refusal.

HEALTH AND FITNESS TO TRAVEL
Guests warrant that they are fit to travel by sea and that their conduct or condition will not impair the safety of the cruise ship or inconvenience the other Guests. Any Guest with a condition that may affect his/her fitness to travel is strongly encouraged to check with their personal physician regarding their ability to travel and to obtain a written physician’s certificate of Guest’s fitness for an international sea voyage. If it appears to Mad Fresh Entertainment, the Ship’s Master or the cruise ship’s doctor in their sole discretion that a Guest is for any reason unfit to travel, likely to endanger health or safety, or likely to be refused permission to land at any port, or likely to render Mad Fresh Entertainment liable for Guest maintenance, support or repatriation, then Mad Fresh Entertainment or the Ship’s Master shall have the right to take any of the following courses and Mad Fresh Entertainment shall have no further liability to the Guest: (i) Refuse to embark the Guest at any port; (ii) Disembark the Guest at any port; (iii) Transfer the Guest to another berth or cabin; (iv) If the cruise ship doctor considers it advisable, to place and confine the Guest in the cruise ship’s infirmary, to Guest’s cabin or any other cabin, or to transfer the Guest to a health facility at any port, all at the Guest’s expense. Guest acknowledges that travel by sea involves certain risks and hazards including motion of the vessel by sea conditions and the delay and/or impossibility of immediate evacuation from the vessel in the event of a medical emergency depending on the vessel’s location and prevailing sea and weather conditions. Mad Fresh Entertainment shall have no liability in the event the Guest is refused passage, disembarked, confined to the infirmary or their cabin, or transferred to another berth or cabin pursuant to this section.

MEDICAL SERVICES
The cruise ship has an on-board infirmary staffed by medical professionals that is equipped to handle most emergencies and routine medical procedures. The infirmary has medication for seasickness and other commonly distributed medication. A fee will be charged for on-board medical services. If the situation exceeds the capacity of the on-board infirmary, you will be transferred to medical facilities on shore. Mad Fresh Entertainment strongly recommends that you purchase travel insurance.

Medical services are available on board the cruise ship as a convenience to our Guests. The cruise ship’s doctor and medical personnel are independent contractors and/or vendors and are entitled to charge Guests for any medical services and medicines provided. The cruise ship’s doctor and medical personnel are not under Mad Fresh Entertainment’s control for treating Guests, and Mad Fresh Entertainment shall not be liable in any way for medical services or medicines provided or not provided. Medical facilities on-board and in the various ports of call may be limited. Mad Fresh Entertainment shall not be liable in any way for referring Guests ashore for medical services or for the actual medical services rendered ashore. Mad Fresh Entertainment shall not be responsible to provide wheelchairs or other mobility devices. Guests who require such devices must supply their own or make arrangements to have one delivered on-board prior to their embarkation. Guests using wheelchairs or other mobility assistance devices are responsible to check that suitable accommodations are available at the time of booking and should verify with Mad Fresh Entertainment the particular dimensions of the requested cabin, including but not limited to door widths, and other vessel accessibility features. Mad Fresh Entertainment supports the right of persons with disabilities to travel on-board its Cruise. The cruise line shall not be liable in any way for referring guests ashore for medical services or for the actual medical services rendered ashore. In the event that medical attendance of any kind or ambulance assistance, whether on shore, at sea or by air is required and is provided or ordered by the cruise line or the Ship’s Master or the doctor, the Guest concerned shall be liable for the full charge or cost thereof and shall indemnify the cruise line upon first demand of any costs incurred by the cruise line, its servants or agents. Guests who by reason of illness or through any other cause require special or extra accommodation or special or extra attention during the course of the Cruise will be charged accordingly.

DAMAGE TO THE CRUISE SHIP OR EQUIPMENT
Any Guest action, which results in damages of any kind to the cruise ship or Shipsomnia equipment, is the responsibility of the Guest; replacement costs will be determined and assessed to the Guest prior to their disembarkation. In the event the damage is not discovered until after disembarkation, and the damage is within a Guest cabin, the Lead Guest shall be liable to Shipsomnia for the replacement costs for the damage therein.

AUTHORITY OF THE SHIP’S MASTER TO TERMINATE VOYAGE
In the event the Ship’s Master determines, at his sole discretion, that the Guests’ conduct, intoxication or activity therein endangers the cruise ship or reduces the ability of the vessel to safely muster guests in the event of emergency, the Ship’s Master shall have absolute discretion to discontinue the voyage and return the vessel to its port of embarkation, in which case Mad Fresh Entertainment and the cruise line shall have no further liability to Guests for any claims related to such termination of voyage.

Guests agree to indemnify and hold harmless Mad Fresh Entertainment and the cruise line from any and all claims that may arise in the event the Ship’s Master takes such action.

ADDITIONAL CRUISE LINE TERMS & CONDITIONS
In addition to the terms outlined herein, you are also bound by the terms & conditions set forth in the cruise line ticket documentation and Passenger Contract. However, the terms and conditions set forth at the time of reservation supersede those policies set forth in the Cruise Line Passenger Contract. Please refer to the Cruise Line Passenger Contract for details.

RIGHTS OF USE
Mad Fresh Entertainment reserves the right to incorporate any pictorial, record and other illustration portrayals of passenger in any photographic means of any nature for the intention of buying and selling, marketing, trading, promotion or otherwise, without compensation to Guest(s), and all rights, titles and interest therein will be. Mad Fresh Event’s sole property, free from any claims by Guest(s) or any person deriving any rights or interest from Guest(s) whatsoever.

PRIVACY
User privacy is very important to Mad Fresh Entertainment, which is why we’ve created a separate Privacy Policy in order to explain in detail how we collect, manage, process, secure, and store your private information. Our privacy policy is included under the scope of these terms and conditions. Read our privacy policy for more information.

SANCTIONS
In compliance with applicable U.S law, including but not limited to sanctions administered by the U.S. Treasury Department’s Office of Foreign Assets Control (OFAC) (the “OFAC Regulations”), citizen or resident of specific countries, including Cuba, Iran, North Korea, Syria, Sudan, or any country whilst they are subject to sanctions administered by OFAC and/or with specific individuals or entities whose names appear on OFAC’s List of Specially Designated Nationals and Blocked Persons (or “SDN List”) will not be allowed to board the cruise ship.

Mad Fresh Entertainment will not be liable for any denial of boarding the cruise ship for any guest due to U.S sanctions.

FORCE MAJEURE
Mad Fresh Entertainment shall not be liable for any loss, injury, damage, or inability to host Shipsomnia arising from any Force Majeure circumstances including, but not limited to: war, terrorism, fire, natural disasters, communicable diseases or epidemics such as norovirus and avian influenza, Acts of God, labor strikes, bankruptcy, inability to procure fuel, Acts of State, failure of subcontractors to perform, or any other events beyond Mad Fresh Entertainment’s reasonable control. Mad Fresh Entertainment shall not be liable to the Guest and the Guest shall not be entitled to any refund if the Guest is unable to reach the scheduled port of embarkation due to airline strikes, cancelled flights or other natural conditions of the earth or weather which make it difficult or impossible for the Guest to travel to the vessel’s port of embarkation.

LIMITATION OF LIABILITY
All Guests expressly understand and agree that any claim against us shall be limited to the amount Guests have paid, if any, for use of products and/or services. Mad Fresh Entertainment will not be liable for any direct, indirect, incidental, consequential or exemplary loss or damages which may be incurred by Guests as a result of using our service, or as a result of any changes, data loss or corruption, cancellation, loss of access, or downtime to the full extent that applicable limitation of liability laws apply. It is understood and acknowledged that Mad Fresh Entertainment is an outside, independent promoter and does not retain the Cruise operator. In consideration of participating and attending Shipsomnia, the Guest voluntarily assume all risks while on the Cruise and release Mad Fresh Entertainment of and from any and all liability, actions, causes of action, suits, injury or death, loss or damage of property, claims, attorney’s fees and demands whatsoever that may be sustained by the Guest at Shipsomnia. This release shall be binding upon you, and your heirs, next of kin, executors and personal representatives. Mad Fresh Entertainment cannot be held responsible for changes on the Cruise that vary from what is noted on Shipsomnia website at the time of purchase or anytime leading up to the event or during the event. The Cruise operated under the direction of the cruise operator may change their offerings at their own discretion and retains the right to do so. Mad Fresh Entertainment will do our best to please Guests of Shipsomnia, but does not control the actions of the cruise operator and acts only as a third party producing an event on their property. Any issues arising between Guests and the cruise pertaining to cruise matters shall be taken up with the cruise directly, and while Mad Fresh Entertainment may assist on our Guests’ behalf, ultimately Mad Fresh Entertainment cannot be held responsible for actions, incidents, policies, or procedures that are employed by the cruise operator. The Guests’ decision to purchase and make a payment for Shipsomnia constitutes their acknowledgment of and consent to all of the terms and conditions of Shipsomnia, including the limitations of liability described in it. All disputes and matters whatsoever related to or involving Mad Fresh Entertainment shall be governed and litigated by the laws in Singapore.

COPYRIGHTS/TRADEMARKS
All content and materials available on www.shipsomnia.com, including but not limited to text, graphics, website name, code, images and logos are the intellectual property of Mad Fresh Events, and are protected by applicable copyright and trademark law. Any inappropriate use, including but not limited to the reproduction, distribution, display or transmission of any content on this site is strictly prohibited, unless specifically authorized by Mad Fresh Events.

TERMINATION OF USE
All Guests agree that we may, at our sole discretion, suspend or terminate Guest access to all or part of our website and services with or without notice and for any reason, including, without limitation, breach of this User Agreement. Any suspected illegal, fraudulent or abusive activity may be grounds for terminating Guest relationship and may be referred to appropriate law enforcement authorities. Upon suspension or termination, Guests right to use the Resources we provide will immediately cease, and we reserve the right to remove or delete any information that Guests may have on file with us, including any account or login information. You acknowledge and agree that it is your responsibility to review this User Agreement periodically to familiarize yourself with any modifications. Your continued use of this site after such modifications will constitute acknowledgment and agreement of the modified terms and conditions.

GUESTS REPRESENTATIONS AND WARRANTIES TO MAD FRESH ENTERTAINMENT
Without limiting anything set forth in these terms and conditions, Guests hereby represent and warrant that (a) Guest will not violate any applicable laws, ordinances and/or regulations at or in connection with Shipsomnia and/or activities corresponding to your transactions with Mad Fresh Entertainment and/or via Shipsomnia website; (b) Guest is of sufficient legal age and authority to enter into any transaction with Mad Fresh Entertainment and/or via Shipsomnia reservations website, to attend Shipsomnia, and to create legal binding obligations for any liability you may incur as a result of entering into this agreement; (c) Guest is an authorized user of the credit or debit card used to enter into any transaction with Mad Fresh Entertainment and/or via Shipsomnia reservations website; (d) Guest shall at all times be in compliance with any and all terms, conditions, policies and rules set forth by Mad Fresh Entertainment and/or any applicable third party; (e) Guest has obtained any and all passports, visas, health information and/or other permission necessary in connection with his/her transaction with Mad Fresh Entertainment and/or via the Shipsomnia reservations website; and (f) Guest will not attempt to charge back his/her purchase with his/her bank or credit card company.  Any attempt by Guest to charge back any or part of the purchase price or other charges incurred in connection with Shipsomnia, shall allow Mad Fresh Entertainment to (a) cancel Guest’s reservation for the then-current or any future Shipsomnia Cruise, or (b) refuse to accept any reservation for any upcoming Shipsomnia Cruise(s).
